Well, modifying a divorce settlement can be straightforward or very difficult, depending on whether or not your former partner is on board with the changes. But the basic process is that you need to draw up a modified version of the divorce agreement, and then file with the court so the court mandate can be updated. Do not try to make changes based on informal agreements alone, as that can get you serious trouble later.

If your former partner is not on board with the changes, this becomes more difficult. You’ll need to either a) negotiate a new agreement with your former partner or b) file a motion with the local court so you can petition a judge for the change. Or rather, so your attorney can petition the judge for you.
