The way I understand it, not everyone is granted bail. I think it really depends on the specific person and charge. That being said, most defendants are.

I think it’s only when the defendant is being charged with a very serious crime or when they might be considered a danger to the public that they’re not granted bail. For example, someone being charged with murder or with a history of violent crime might be denied bail in order to protect the public.

Alternatively, the judge might just set a crazy high bail amount, like in the millions. I’m pretty sure some Las Vegas bail bonds have been set that high. Bail bondsman like Escape Bail Bonds can pay the bail for a defendant, but they take a premium, so if the bail is this high, a defendant might just not be able to afford the premium.

Also, the bail is there to guarantee that the defendant will show up for their court date, so if the judge is confident that they’ll cooperate, they might not set any cash bail at all. For example, if someone owns a business or property in the state, or has something substantial tying them to the area, it’s less likely they’ll take off and miss court. Therefore, the judge might not feel it’s necessary to set a cash bail.
