Custody trials are one of the most difficult and heartbreaking types of cases I’ve personally had to deal with. As with all areas of the law, from petty theft to a murder trial, the aim of a free democratic republic is always fairness. However, it can be difficult to be completely fair all of the time. Unfortunately, miscarriages of justice or unfair rulings do happen. Courts can only go on the evidence it has and this often isn’t perfect.
In my opinion, there are a few things you can do to ensure a fair trial that everyone can be happy with. First of all, all parties involved need to act reasonably and honestly. Problems arise when divorced couples act out of spite or jealousy. Second of all, don’t try to conduct the trial yourself. Contact a reputable custody attorney to represent you. These kinds of lawyers exist to make the trial as fair as possible.
